Welcome to Black Rhino Safaris. These Terms and Conditions are intended to ensure the safety, enjoyment and responsible delivery of our safari experiences, tours and related services.

By making or confirming a booking with Black Rhino Safaris, the client, booking operator or travel agent acknowledges that they have read, understood and agreed to these Terms and Conditions. These terms apply to all clients and participants unless Black Rhino Safaris expressly agrees otherwise in writing for a specific booking.

1. Bookings and Services

Black Rhino Safaris provides or arranges safari-related experiences and services, which may include wildlife tracking, guided walks, game drives, cultural and heritage tours, photographic safaris, transport, transfers, accommodation and other activities.

All bookings are subject to availability, operational requirements, applicable permits, park regulations and any specific conditions communicated at the time of booking.

The booking price is based on the services, itinerary and number of participants confirmed at the time of booking. Any requested changes must be agreed to by Black Rhino Safaris and may result in additional charges or changes to the arrangements.

Where third-party suppliers are involved, their own booking conditions, safety requirements and operational policies may also apply.

2. Cancellation, No-Show and Lateness Policy

The following policy applies to all bookings unless an alternative arrangement is expressly agreed to in writing by Black Rhino Safaris for the specific booking.

2.1 Cancellations by the Client, Operator or Agent

  • Cancellations received before 8:00 AM on the day prior to the booked activity may be eligible for a refund, subject to the specific booking terms and any non-refundable costs already incurred by Black Rhino Safaris.

  • Cancellations received after 8:00 AM on the day prior to the booked activity are strictly non-refundable.

  • Where a cancellation occurs after the applicable cancellation deadline, the full booked amount remains due and payable, regardless of whether the client participates in the activity.

2.2 Reduction in Participant Numbers

The booking price is based on the number of participants confirmed at the time of booking.

If fewer participants attend than originally booked:

  • The original booking price remains unchanged.

  • No refund, credit or price reduction will be provided for participants who do not attend.

  • The full amount applicable to the original confirmed booking remains due and payable.

2.3 No-Shows

A client or participant who fails to arrive or attend the booked activity without providing cancellation within the applicable cancellation period will be treated as a no-show.

No refunds or credits will be provided for no-shows, and the full booked amount remains due and payable to Black Rhino Safaris.

2.4 Late Arrivals

Clients are responsible for arriving at the designated departure point at the agreed time.

Late arrival may affect the duration, itinerary and activities included in the booking. Where the remaining timeframe is insufficient to safely or reasonably complete the activity as planned, certain activities, locations or components may be shortened, modified or omitted.

Black Rhino Safaris will make reasonable efforts to accommodate late arrivals where operationally possible. However, no refund, credit or reduction in the booking price will be provided where an activity is shortened, modified or unable to be completed as a result of the client's late arrival.

Where late arrival results in the client missing the activity entirely, it will be treated as a no-show and the full booked amount remains due and payable.

3. Cancellations or Changes by Black Rhino Safaris

Black Rhino Safaris reserves the right to cancel, postpone, modify, suspend or terminate a booking or activity where reasonably necessary, including but not limited to circumstances involving:

  • Unsafe weather or environmental conditions, including flooding, extreme weather, fire or other natural events.

  • Wildlife encounters or safety concerns that may place clients, staff, guides, wildlife or property at unreasonable risk.

  • Road, vehicle or equipment conditions that make an activity unsafe or impractical.

  • Government, National Park, wildlife authority or other regulatory restrictions, closures or directives.

  • Force majeure or circumstances beyond the reasonable control of Black Rhino Safaris, including natural disasters, civil unrest, strikes, road closures or other unforeseen events.

  • The unavailability of operational resources required to safely deliver the booked activity, despite reasonable efforts.

  • A client or group member failing to comply with safety instructions, park regulations, wildlife rules or reasonable directions from Black Rhino Safaris or its representatives.

  • A client being intoxicated, under the influence of drugs, medically unfit, aggressive, abusive or otherwise behaving in a manner that compromises safety, comfort or wellbeing.

  • Misrepresentation or falsification of information provided by a client, including medical, identification or other information relevant to the booking.

  • Any other circumstance in which Black Rhino Safaris reasonably determines that the activity cannot be conducted safely, legally or responsibly.

Where Black Rhino Safaris cancels an activity before it commences, it will, where reasonably possible, offer an alternative date, activity or suitable arrangement.

Where an alternative cannot reasonably be provided, any refund will be determined having regard to the circumstances of the cancellation and any non-refundable costs or third-party charges already incurred.

Where an activity is cancelled, shortened, modified or terminated because of a client's conduct, actions, omissions or breach of these Terms and Conditions, no refund will be payable, and the client remains responsible for applicable costs, losses or expenses incurred by Black Rhino Safaris.

For cancellations arising from safety concerns, weather, wildlife, force majeure or other circumstances beyond the reasonable control of Black Rhino Safaris, the company will not be liable for additional costs, losses, expenses or consequential losses incurred by the client, including accommodation, transport, flights, alternative activities or other travel arrangements, to the extent permitted by applicable law.

The safety and wellbeing of clients, staff, guides and wildlife will remain a primary consideration in all operational decisions.

4. Wildlife Encounters and Itinerary Changes

All safari activities take place in natural environments where wildlife and environmental conditions are unpredictable.

Black Rhino Safaris does not guarantee wildlife sightings, proximity to particular animals, specific animal behaviour or the availability of particular activities or locations.

Routes, departure times, itineraries, walking distances and activity durations may change due to weather, wildlife movements, safety considerations, park regulations, road conditions or other operational requirements.

Clients acknowledge that wildlife tracking and other nature-based activities require flexibility, patience and compliance with guide instructions.

The welfare of wildlife and the protection of the natural environment take priority over obtaining a particular sighting or completing a particular activity.

5. Client Conduct and Safety

All clients must follow reasonable instructions given by Black Rhino Safaris, its guides, drivers, representatives and independent activity providers.

Clients must:

  • Comply with all applicable National Park, reserve, lodge, wildlife and safety regulations.

  • Maintain a safe and respectful distance from wildlife as instructed by their guide.

  • Avoid actions that endanger themselves, other participants, staff, guides, wildlife or property.

  • Disclose relevant medical conditions, allergies, disabilities, medication requirements or other circumstances that may affect their safety or the safety of others.

  • Behave respectfully towards local communities, staff, guides, fellow participants and the natural environment.

  • Refrain from participating while intoxicated, under the influence of drugs or otherwise unfit to participate safely.

  • Provide accurate and complete personal, medical, identification and insurance information when requested.

Black Rhino Safaris reserves the right to refuse participation, remove a participant from an activity or terminate services where reasonably necessary for safety, legal compliance, wildlife protection or the wellbeing of others.

Where cancellation or termination results from a client's conduct or breach of these terms, no refund will be payable to the extent permitted by applicable law.

6. Voluntary Acceptance of Risk, Waiver and Indemnity

Safari activities take place in remote and unpredictable environments and involve inherent risks.

These risks may include, but are not limited to:

  • Encounters with wild animals and unpredictable wildlife behaviour.

  • Vehicle travel, road conditions, uneven terrain and guided walks.

  • Weather conditions, water-based activities and environmental hazards.

  • Illness, personal injury, disability, accident or death.

  • Delays in receiving medical assistance or emergency evacuation due to remote locations.

  • Loss of or damage to personal belongings or property.

  • Risks associated with independent third-party service providers.

By participating in any Black Rhino Safaris activity, clients acknowledge and voluntarily accept the inherent risks associated with the services they undertake.

Clients agree to follow all reasonable safety instructions and understand that wildlife sightings, animal proximity and specific activities cannot be guaranteed.

6.1 Mandatory Indemnity Agreement

Signing the Black Rhino Safaris Voluntary Acceptance of Risk, Waiver and Indemnity is a condition of participation.

Each participant must complete and sign the required agreement before participating in activities or services where the agreement is required. Participants who voluntarily choose not to sign may be refused boarding of vehicles or denied participation without liability to Black Rhino Safaris, to the extent permitted by applicable law.

Participants under 16 years of age must be accompanied by an adult, who must sign the indemnity agreement on their behalf.

The signed indemnity agreement operates alongside these Terms and Conditions. In the event of any inconsistency, the documents should be interpreted together to the extent legally permissible.

Nothing in these terms or the indemnity agreement excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

7. Medical Fitness and Travel Insurance

Clients are responsible for ensuring that they are medically and physically fit for their chosen activities and that they disclose any relevant medical condition, disability, allergy, medication requirement or other circumstance that may reasonably affect safety.

Clients are responsible for obtaining adequate travel and medical insurance appropriate to their activities and travel arrangements. Recommended cover includes:

  • Medical expenses and hospitalisation.

  • Emergency evacuation and repatriation.

  • Personal accident and injury.

  • Trip cancellation and interruption.

  • Loss, theft or damage to personal belongings.

Clients acknowledge that Black Rhino Safaris does not guarantee that an insurance policy will respond to a particular claim.

Due to the remote nature of safari operations, medical assistance or emergency evacuation may be delayed. Clients should ensure that their insurance is appropriate for the activities they intend to undertake.

8. Third-Party Service Providers

Certain services may be provided or arranged by independent third-party operators, including accommodation providers, transport operators, lodges, airlines and activity providers.

Clients agree to comply with the applicable terms, conditions, safety requirements and instructions of those providers.

To the extent permitted by applicable law, Black Rhino Safaris is not responsible for acts, omissions, services, delays, losses, damage, illness, injury or other consequences attributable to an independent third-party provider.

Where a third-party service is included in a booking, any refund, amendment or cancellation may also be subject to that provider's own conditions and charges.

9. Personal Belongings and Client Information

Clients are responsible for their personal belongings, valuables, travel documents, equipment and other possessions throughout their participation in safari activities.

To the extent permitted by applicable law, Black Rhino Safaris accepts no responsibility for loss of or damage to personal belongings except where liability cannot lawfully be excluded.

All information supplied by clients must be true, accurate and complete.

Providing false, misleading or deliberately falsified information, including personal, medical, insurance or identification information relevant to a booking, may result in refusal of participation, cancellation of services or other appropriate action. Any resulting refund entitlement will be assessed in accordance with these terms and applicable law.

10. Liability, Waiver and Indemnification

To the fullest extent permitted by applicable law, clients agree to the waiver, release and indemnity provisions contained in the signed Voluntary Acceptance of Risk, Waiver and Indemnity agreement.

Those provisions address claims, liabilities, losses, damages, injuries, illness, death, costs and expenses arising from participation in safari services, including matters associated with inherent risks, a client's own acts or omissions, negligence or failure to follow reasonable instructions.

The indemnity agreement also addresses claims brought by the client or by persons claiming through the client, to the extent permitted by applicable law.

Nothing in these Terms and Conditions is intended to exclude or restrict any consumer rights, statutory protections or liability that cannot lawfully be excluded or restricted.

11. Force Majeure and Circumstances Beyond Our Control

Black Rhino Safaris will not be responsible for a failure or delay in delivering services to the extent that it results from circumstances beyond its reasonable control, including natural disasters, extreme weather, fire, flooding, civil unrest, strikes, road closures, regulatory restrictions or other unforeseen events.

Where such circumstances affect a booking, Black Rhino Safaris will endeavour to communicate with the client and, where reasonably possible, explore alternative arrangements in accordance with Section 3 of these Terms and Conditions.

Clients remain responsible for their own travel arrangements and any additional accommodation, transport or related expenses, subject to applicable law and any specific written agreement.

12. Amendments and Special Arrangements

Any exception, amendment or alternative arrangement to these Terms and Conditions must be expressly agreed to in writing by Black Rhino Safaris for the specific booking or circumstance concerned.

Such an agreement applies only to that particular booking or circumstance and does not create a permanent amendment, waiver, precedent or entitlement for future bookings unless separately agreed in writing.

13. Acceptance of Terms and Conditions

By confirming a booking with Black Rhino Safaris, the client, booking operator or agent acknowledges that they have read, understood and accepted these Terms and Conditions.

The client is responsible for ensuring that all participants in their booking are made aware of the applicable terms, safety requirements and participation conditions.

Acceptance of these Terms and Conditions does not replace the requirement to complete and sign any separate indemnity agreement required for participation.

14. Applicable Law

These Terms and Conditions and any dispute arising from a booking or service will be subject to the applicable laws and legal requirements governing the relevant transaction and services.

Nothing in these terms is intended to override mandatory legal protections or statutory obligations that apply to Black Rhino Safaris or its clients.

Clients are encouraged to seek independent legal advice if they require clarification regarding their rights and obligations.
